DELMARO PURCHASE AGREEMENT

By purchasing any Delmaro product, including electric jetboards, eFoils, accessories, batteries, chargers, or related equipment (“Products”), you (“Customer”) agree to the following terms and conditions.

1. PRODUCT USE & ASSUMPTION OF RISK

Delmaro products are high-performance electric watercraft intended for recreational use by responsible riders.

The Customer understands and acknowledges that riding electric watercraft involves inherent risks, including but not limited to:
- Serious injury
- Loss of control
- Collision with watercraft, docks, swimmers, or obstacles
- Electrical or mechanical malfunction
- Drowning or death

By purchasing and/or using Delmaro products, the Customer voluntarily assumes all risks associated with operation and use.

Customers should always:
- Wear a properly fitted life jacket / impact vest
- Use a safety leash when applicable
- Ride within their skill level
- Follow local boating and waterway regulations
- Avoid operating under the influence of drugs or alcohol

2. CUSTOMER RESPONSIBILITY

The Customer is solely responsible for:
- Safe operation of the product
- Reading all provided instructions and safety materials
- Proper charging, storage, and maintenance
- Compliance with local laws and watercraft regulations
- Ensuring any rental customers or third parties operate equipment safely

Delmaro is not responsible for misuse, negligent operation, unauthorized modifications, or improper maintenance.

3. RENTAL & COMMERCIAL USE

Products used for:
- Rentals
- Tours
- Lessons
- Commercial operations
- Fleet services

may require additional insurance, permits, inspections, or local approvals depending on jurisdiction.

The Customer is solely responsible for obtaining any necessary:
- Liability insurance
- Business licenses
- Waterway permits
- Commercial operating approvals

Delmaro does not guarantee commercial profitability or rental income.

4. ORDER CONFIRMATION & PAYMENT

Orders are not considered finalized until:
- Payment is received
- Order details are confirmed
- Availability is verified

Delmaro reserves the right to refuse or cancel orders at any time prior to shipment.

Custom orders, fleet orders, and special configurations may require deposits and additional lead times.

5. SHIPPING & DELIVERY

Shipping timelines are estimates only and may vary due to:
- Manufacturing schedules
- Freight carrier delays
- Customs processing
- Weather or supply chain disruptions

Delmaro is not liable for delays outside of its reasonable control.

Risk of loss transfers to the Customer upon delivery.

6. WARRANTY

Delmaro provides a limited warranty covering manufacturer defects under normal recreational use.

The warranty does not cover:
- Commercial/rental abuse
- Impact damage
- Water damage caused by improper sealing or maintenance
- Cosmetic wear
- Improper storage
- Unauthorized repairs or modifications

Warranty periods and coverage details may vary by product.

7. RETURNS & CANCELLATIONS

Due to the nature of electric watercraft products:
- Deposits may be non-refundable
- Custom orders are non-refundable
- Used or water-tested products are not eligible for return

Approved returns may be subject to restocking fees.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Delmaro shall not be liable for:
- Indirect damages
- Loss of income
- Business interruption
- Watercraft accidents
- Personal injury
- Property damage
- Consequential damages arising from product use

Maximum liability shall not exceed the original purchase price of the product.

9. PRODUCT SPECIFICATIONS

All specifications, images, renderings, and performance estimates are subject to change without notice.

- Speed
- Runtime
- Weight capacity
- Battery life
- Range

may vary depending on rider weight, water conditions, weather, riding style, and maintenance.

10. ACCEPTANCE OF TERMS

By purchasing, using, or operating any Delmaro product, the Customer acknowledges they have:
- Read this agreement
- Understood the risks
- Accepted all terms and conditions voluntarily
